This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.
This Notice of Privacy Practices describes how we may use and disclose your protected health information to carry out treatment, payment or health care operations and for other purposes that are permitted or required by law. It also describes your rights to access and control your protected health information. “Protected health information” is information about you, including demographic information, that may identify you and that relates to your past, present or future physical or mental health or condition and related health care services.
Every time you have a consulting session with a Wise Passage Nurse Consultant, a record of your session is made. This record contains “protected health information,” which is information (including demographic) about you that may identify you and that related you to your past, present, or future physical or mental health or condition. We are committed to safeguarding and keeping private your protected health information. This Notice describes the permissible uses and disclosures that Wise Passage may make regarding your protected health information.
By law we are required to provide you with this Notice and to follow the policies we describe here. We reserve the right to change these policies in accordance with applicable law. Any changes made will be effective for the health information we already have as well as any information we receive in the future. If we do revise this Notice, a copy of the new Notice will be posted on our website. You can print out a copy of the new Notice from the website.
HOW WE MAY USE AND DISCLOSE YOUR PROTECTED HEALTH INFORMATION
1. Treatment. Your health information may be used by staff members or disclosed to other healthcare professionals for the purpose of evaluating your health and recommending treatments.
2. Payment. All payments will be made by credit cards on the Wise Passage website, so no disclosure of your protected health information will be necessary in this regard.
3. Health Care Operations. We may use and disclose your protected health information for our health care operations. These uses and disclosures are necessary to ensure that our clients receive quality health care. For example, medical staff or a quality improvement team may review your case and others like it to evaluate and promote quality. We may also use your information to insure the smooth operation of Wise Passage such as financial reporting.
Your information also may be disclosed to business associates that perform various services for Wise Passage.
4. Treatment Alternatives. We may use and disclose your protected health information to let you know about or to recommend certain treatment alternatives or options that may be of interest to you.
5. Health-Related Benefits and Services. We may use and disclose your protected health information to let you know about health-related benefits or services that may be of interest to you.
6. Others Involved in Your Health Care. We may disclose your protected health information to people such as family, relatives and friends who are helping care for you or helping you pay for your services from Wise Passage. The information disclosed will directly relate to that person’s involvement in your health care. You can agree or object to such a disclosure. If you are unable to agree or object, we may disclose such information that, in our professional judgment, we deem to be necessary and in your best interests.
7. As Required by Law. We may use or disclose your protected health information to the extent required by law. For example, we may be required to report domestic abuse or neglect. We may also be required to disclose health information in response to a court order.
8. Public Health. We may be required to disclose your protected health information for public health activities as required by law, such as reporting someone who may have been exposed to a communicable disease or who is at risk of contracting or spreading the disease.
9. Health Oversight. We may disclose your protected health information to health oversight agencies, including governmental agencies, for activities authorized by law. These activities include audits, investigations, inspections, and licensure of those who work in the health care field or governmental benefit programs.
YOUR RIGHTS
1. Request a restriction on certain uses and disclosure of your information. You have the right to request that any part of our health care information not be disclosed to someone who is involved in your care, such as a family member or friend.
To request a restriction, please contact Wise Passage in writing. Include the particular information you wish to limit and the person or persons to whom you want the restriction to apply.
2. Receive Confidential Communications. You have the right to request that we communicate with you about medical matters by alternative means. For example, you can request that we only contact you by mail sent to a private address. We may not ask you for the reason for the confidential communications, and we must comply with all reasonable requests. You may make your request for confidential communications to Wise Passage in writing.
3. Inspect and Copy Your Health Information. With few exceptions, you have the right to inspect and have a staff member copy the medical information that the Wise Passage Nurse Consultant has created to document your consulting sessions. We may charge a reasonable fee for costs involved in copying, mailing, or other supplies involved in fulfilling your request.
4. Amend Your Protected Health Information. If you believe that the health information we have about you is incorrect or incomplete, you have the right to request an amendment to that information. You have the right for as long as we maintain the information. You must make such a request to Wise Passage in writing and include a reason as to why the information should be changed. We may deny your request for several reasons, including, among others, that we did not create the information in dispute or that we believe the health information is correct and complete. For further information about amending your health information, please contact Wise Passage.
5. Receive an Accounting of Disclosures. You have the right to ask for an accounting of how and to whom your protected health information has been disclosed.
6. Complain. If you believe your privacy rights have been violated, you may file a complaint with us or with the Secretary of the Department of Health and Human Services. Please contact Wise Passage if you want to file a complaint with us. All complaints must be submitted in writing. We will not retaliate against you for filing a complaint.
7. Obtain a Paper Copy of This Notice. You have the right to receive a paper copy of this Notice, which you may request at any time.
